PROFILE

Edric Pan is a partner in Rodyk & Davidson LLP's Litigation & Arbitration Practice Group.

He has handled a wide range of civil and commercial litigation work, including international commercial disputes, actions relating to breaches of directors' and fiduciary duties, multi-million dollar insurance related claims, employment disputes, professional negligence, aviation related claims, construction related disputes and professional disciplinary proceedings.

In over a decade of litigation practice, Edric has been involved in many high profile matters which have been contested at the highest levels of Singapore's court system.

Edric has acted for several international fund management companies in a lawsuit against an Indonesian company and its shareholders, seeking payment of the sum of about US$30 million. Issues involved include forum non conveniens, force majeure, collateral undertakings and validity of service of process.

He has represented members of a prominent Indonesian family in a highly publicised action by their former joint venture partners (one of the world's largest life insurance companies) in respect of economic torts allegedly committed by the Indonesian family in Indonesia.

Another notable matter which Edric has handled was a dependency action brought by the widow of a prominent local businessman. In that case, the High Court gave one of the highest dependency awards ever made in Singapore, and in doing so, made the landmark ruling that the widow, who had instituted divorce proceedings and had obtained a decree nisi before the death of her husband, was still a "wife" for the purposes of the Civil Law Act and was hence still entitled to claim for loss of dependency.

Edric's portfolio also involves a considerable amount of non contentious work. This includes providing regulatory advice and contractual drafting in the insurance, employment and aviation fields.

He is regularly involved, for instance, in drafting template employment contracts and advising on remuneration and termination issues for institutional clients. He advises on insurance and reinsurance related regulatory issues, and has considerable experience in the drafting of policy documents and other related insurance materials.

Edric is also experienced in the area of criminal law, and has acted for various clients in the defence of charges under the Securities Industry Act, Penal Code, Road Traffic Act and other statutory provisions.

In addition, Edric has delivered workshops and seminars on employment law and insurance law, and also co-authored a chapter in the Employment Law volume of Halsbury's Laws of Singapore.
